Terms & Conditions:

Orders:
Work will only begin when View it Virtually accepts the full design specifications detailing all requirements. View it Virtually reserves the right not to accept an order at its discretion. Changes and additions to design specifications may be made prior to customer's requirements, but View it Virtually reserves the right to charge the customer for any work undertaken until the time at which the change or re-designed specifications are provided to us.

Should the customer cancel an order after order acceptance by View it Virtually the customer will be charged for all work undertaken up until the time notice of cancellation is received by View it Virtually.

Delivery & Completion:
View it Virtually will make every effort to deliver its services ordered within the time frames specified. View it Virtually will keep its customers informed of any delays arising from circumstances beyond it's control. In no event will View it Virtually be held responsible for losses incurred by the customer for delivery delays caused by circumstances outside its control. Unless otherwise agreed, the customer is responsible for arranging access to the location at which the services are required.

A virtual tour is deemed delivered by View it Virtually when all panoramic images, photographs and any other requirements agreed upon that constitute a complete virtual tour of all areas specified by the customer for the agreed and specified location photographed, have been electronically received by the customer whether that be via email, ftp or any other agreed method made with the customer. If the customer requires the aforementioned files on CD/DVD, then View it Virtually will charge the customer for all postage and handling fees incurred by it.

View it Virtually takes no responsibility for goods or services rendered once they have been delivered and accepted by the customer.

Acceptance of Services:
The customer is deemed to have accepted the goods and services 48 hours after their delivery (delivery is stated above under Delivery & Completion).

Prices:
Prices quoted by View it Virtually are subject to change at any time. View it Virtually will endeavour to inform customers of changes to prices initially quoted and of any chargeable costs for work undertaken additional to those agreed to at the time of order acceptance.

Travel Costs & Expenses:
If goods and services are required to be rendered more than 30 kilometres from the Cairns CBD, the customer will be charged for reasonable travel and accommodation expenses incurred by View it Virtually.

GST:
View it Virtually is not registered for GST and thus no GST is included in it’s prices.

Invoicing:
An invoice will be issued to the customer once the customer accepts the goods and services specified in.

Payment:
A 50% deposit of the total amount agreed upon is required before work will commence. On completion of all work the remainder paid no later than 14 days after the invoice date unless otherwise agreed.

Payment Methods:
View it Virtually does not accept credit card payments. Payments may be made by cash, cheque, or electronic funds transfer (EFT).

Copyright:
All copyright of panoramic and associated imagery which constitute a virtual tour will reside with View it Virtually at all times. View it Virtually reserves the right to seek compensation for any financial losses incurred due to any breach by the customer of copyright laws. Unauthorised use or copying of View it Virtually's virtual reality tour technology and processes is not allowed under any circumstances. View it Virtually reserves the right to use any panoramic images produced by it for promotional reasons in the media, in printed publications, on the world wide web, or as links on its own web sites, without prior permission from the customer.

On customer acceptance of a virtual tour rendered by View it Virtually, the customer is granted a single use licence as follows:
The customer is licensed to use the virtual tour on, and only on, the customer’s own nominated web sites and is not permitted to distribute or share the product with anyone else. Copying, sharing and distributing the finished product on the world wide web or on CD-ROM or on any other medium is not permitted under any circumstances.

Additional copies or usage of a virtual tour beyond those specified in the order acceptance may be permitted subject to payment of additional agreed license fees to View it Virtually.

Due to the technique employed to produce virtual tours a small section of the panorama image (the ‘cap’) on the base of the panorama is without photographic content. View it Virtually normally fills that area with its logo for promotional reasons.

Subject to payment of an additional fee other customer specified logos or images may be incorporated in the ‘cap’.

All copyright for still photos remains with View it Virtually. The customer may use the finished images in any manner providing the intended use is not inappropriate, offensive or insulting to View it Virtually or any other persons.
